SaviorHost İnternet Hizmetleri terms and conditions of use
This is a courtesy translation. In case of any discrepancy, the Turkish version prevails.
This page sets out the rights and obligations relating to the use of SaviorHost services. Please read it carefully before ordering.
1 Parties and Acceptance
- 1.1 This Service Agreement (the “Agreement”) is concluded between SaviorHost İnternet Hizmetleri (“SaviorHost”) and the natural or legal person purchasing services through saviorhost.com (the “Customer”) when the Customer accepts the Agreement electronically during ordering. SaviorHost’s contact details are given at the end of this Agreement.
- 1.2 The Customer acknowledges having been informed, through the product pages and order screen, of the essential characteristics, price, payment and performance terms of the service before ordering.
- 1.3 For Customers who are consumers, the mandatory provisions of Turkish Consumer Protection Law No. 6502 and the Distance Contracts Regulation are reserved. Where any provision of this Agreement conflicts with that legislation, the legislation applies.
2 Definitions
- 2.1 Hosting Services: Linux Web Hosting, WordPress Hosting, E-Commerce Hosting and n8n / Node.js Hosting plans.
- 2.2 Reseller Service: reseller hosting plans that allow the Customer to create hosting accounts for its own clients (“Reseller Clients”) through the KeyHelp reseller panel.
- 2.3 Server Services: VPS, VDS, dedicated server and co-location services.
- 2.4 Client Area: the account area on saviorhost.com where the Customer manages services, invoices and support requests.
- 2.5 Availability: the ratio of the time a service is reachable over the internet in a calendar month to the total time in that month.
3 Subject and Scope
- 3.1 The subject of this Agreement is to set out the rights and obligations of the parties regarding the services purchased by the Customer. The technical features and resource limits of each plan are those published on the relevant product page on the order date.
- 3.2 The Personal Data Protection Notice and the Privacy Policy form an integral part of this Agreement.
4 Service Delivery and 99% Availability Commitment
- 4.1 Services are activated once payment has been received by SaviorHost. Service details are sent to the email address registered in the Client Area.
- 4.2 For Hosting Services and the Reseller Service, SaviorHost commits to 99% monthly Availability. Availability is calculated based on the records of the independent monitoring system used by SaviorHost.
- 4.3 The following are excluded from Availability calculations: (a) planned maintenance announced at least 24 hours in advance and not exceeding 4 hours in total per month; (b) interruptions caused by the Customer’s software, plugins, configuration or exceeding of resource limits; (c) DDoS and similar cyber attacks; (d) failures caused by third parties such as domain registrars, DNS providers or the internet backbone; (e) periods during which the service is suspended under this Agreement; (f) force majeure.
- 4.4 If Availability falls below 99% in a calendar month, the Customer may request compensation by opening a support ticket within 30 days of the end of that month. Compensation is provided by adding, free of charge, service time equal to the difference between the committed and actual Availability, and shall not exceed one month’s service fee. This compensation does not affect the Customer’s statutory rights.
- 4.5 For Server Services, SaviorHost’s obligation is limited to keeping the hardware and network connection operational; the operating system, software, security updates and administration are the Customer’s responsibility.
5 Customer Obligations and Acceptable Use
- 5.1 The Customer is responsible for ensuring that the information provided in the order and Client Area is accurate and up to date, for keeping account passwords confidential and for all actions taken through its account.
- 5.2 The Customer may not use the services to host content contrary to the laws of the Republic of Türkiye, infringe intellectual property rights (including unlicensed, “nulled” or “warez” software), publish malware or phishing pages, run botnet, port-scanning or attack activities, send commercial electronic messages (spam) without the recipient’s prior consent, or mine cryptocurrency in the shared hosting environment.
- 5.3 If the resource limits published for a plan (CPU, RAM, Entry Processes, I/O) are exceeded, SaviorHost will first warn the Customer. If exceeding limits immediately endangers the security or performance of the server or other users, SaviorHost may temporarily restrict or suspend the account without prior notice and will inform the Customer as soon as possible.
- 5.4 Hosting Services and the Reseller Service are provided for publishing websites and may not be used as file storage, backup archives or media distribution (CDN, streaming). A single file may not exceed 1 GB. No inode (file count) limit applies; usage is limited by the plan’s disk quota. “Unlimited traffic” is subject to a fair use policy covering normal website usage.
- 5.5 If a notice of licence infringement or unlawful content is received, SaviorHost may block access to the content concerned or suspend the account. The account is reactivated once the content is removed.
- 5.6 Technical support is provided to the account holder or persons authorized in the Client Area. SaviorHost may verify identity before providing support.
- 5.7 Insulting, threatening or harassing behaviour by the Customer towards SaviorHost staff constitutes a material breach of this Agreement.
6 Special Provisions for the Reseller Service
- 6.1 The reseller Customer is the sole point of contact and responsible party towards Reseller Clients for the accounts it creates through the KeyHelp reseller panel. No direct contractual relationship is established between SaviorHost and Reseller Clients.
- 6.2 The reseller Customer must apply to Reseller Clients rules at least equivalent to the acceptable use rules of this Agreement and is responsible for any breach of those rules by Reseller Clients.
- 6.3 SaviorHost does not provide direct support to Reseller Clients. In cases of security or legal necessity, it may suspend the relevant sub-account and will notify the reseller Customer.
- 6.4 The service is provided as white-label; SaviorHost does not show its brand to Reseller Clients except where legally required, such as at the request of official authorities.
- 6.5 With respect to personal data of Reseller Clients, the reseller Customer is the data controller and SaviorHost is the data processor under Turkish Personal Data Protection Law No. 6698.
7 Backups and Data Protection
- 7.1 Weekly automatic backups are taken for Hosting Services and the Reseller Service. These backups are kept for convenience; the existence or integrity of a backup for any particular date is not guaranteed. The Customer is responsible for keeping its own up-to-date copy of its data.
- 7.2 For Server Services, backups are entirely the Customer’s responsibility.
- 7.3 Restorations from backup are performed on the same control panel (KeyHelp). Requests to migrate to a different panel may be charged separately.
- 7.4 Data belonging to expired or deleted services may not be recoverable. The Customer is responsible for retrieving its data before the service ends.
8 Fees, Payment and Renewal
- 8.1 Service fees are the prices published on saviorhost.com on the order date. Whether VAT is included is shown on the order and invoice screens. For services priced in a foreign currency, payments in Turkish lira are made at the exchange rate displayed on the payment screen.
- 8.2 Services renew for the same period at the end of the selected billing period. The renewal invoice is sent to the Customer’s registered email address before the due date. The Customer may submit a cancellation request through the Client Area before the end of the period for any service it does not wish to renew.
- 8.3 SaviorHost may change its prices. New prices apply only from the next renewal period and are notified to the Customer at least 30 days in advance; in that case the Customer may choose not to renew.
9 Late Payment, Suspension and Deletion
- 9.1 Services not paid by the due date may be suspended. Access is disabled during suspension, but data is not deleted.
- 9.2 If payment is not made within 7 days of suspension, the service may be terminated and the account’s data permanently deleted. SaviorHost sends a notice to the Customer’s registered email address before deletion.
- 9.3 A suspended service is reactivated without additional charge once payment is made. If restoration of a deleted account from an existing backup is requested, the restoration may be charged separately.
- 9.4 For Customers who are merchants, default interest may be claimed in the event of late payment under Article 1530 of Turkish Commercial Code No. 6102.
10 Right of Withdrawal and Money-Back Guarantee
- 10.1 As the services begin to be performed electronically immediately after the order with the Customer’s consent, there is no statutory right of withdrawal under the exceptions set out in Article 15 of the Distance Contracts Regulation. By confirming the order, the Customer agrees to immediate performance. This does not affect the money-back guarantee below.
- 10.2 15-Day Money-Back Guarantee: For Hosting Services and the Reseller Service, regardless of the billing period (monthly, 6-monthly, yearly, 2-yearly and 3-yearly), a refund may be requested without giving reasons within 15 days of the service’s activation date.
- 10.3 For VPS and VDS services paid yearly, a refund may be requested within 15 days of activation, provided the Customer gives a justified reason.
- 10.4 Refund requests are submitted by opening a support ticket in the Client Area. Approved refunds are made within 14 days of approval to the original payment method or a bank account designated by the Customer.
- 10.5 Domains, dedicated servers, co-location services and the fees for licences and similar third-party products purchased with a service are not refundable.
- 10.6 Period discounts applied to long-term payments (6 months, 1, 2 and 3 years) are not considered campaigns and do not prevent use of the money-back guarantee. Services purchased with special campaigns or promo codes are not refundable.
- 10.7 The money-back guarantee may be used once per service type every 12 months. Services suspended or terminated due to a breach of Article 5 are not refundable.
11 Limitation of Liability
- 11.1 Except in cases of intent or gross negligence, SaviorHost is not liable for indirect damages such as loss of profit, loss of business, loss of data or loss of reputation.
- 11.2 For Customers who are merchants, SaviorHost’s total liability under this Agreement, except in cases of intent or gross negligence, is limited to the fees paid for the relevant service in the 12 months preceding the date the damage occurred. For consumers, mandatory statutory provisions are reserved.
- 11.3 The Customer is solely responsible for the content it hosts on the services and agrees to indemnify SaviorHost for losses arising from claims or sanctions brought against SaviorHost by third parties or authorities because of such content.
- 11.4 Neither party is liable for failing to perform its obligations due to force majeure events beyond its control, such as natural disasters, war, epidemics, power outages, general internet infrastructure failures, cyber attacks and decisions of authorities.
12 Personal Data and Legal Obligations
- 12.1 The Customer’s personal data is processed in accordance with Turkish Personal Data Protection Law No. 6698 and the Personal Data Protection Notice.
- 12.2 Under Law No. 5651 and related legislation, SaviorHost, as a hosting provider, retains the traffic information it is required to keep and shares it with competent authorities upon request.
13 Term and Termination
- 13.1 This Agreement remains in force for the billing period selected for each service and is extended automatically as the service is renewed.
- 13.2 The Customer may terminate the Agreement at any time by submitting a cancellation request through the Client Area. Unless otherwise requested, cancellation takes effect at the end of the current billing period. Refund terms are subject to Article 10.
- 13.3 SaviorHost may terminate the Agreement immediately for just cause if the Customer breaches Article 5, if a legal obligation arises or if payment obligations are not fulfilled. In terminations due to the Customer’s material breach, the fee for the unused period is not refunded, subject to mandatory statutory provisions.
- 13.4 SaviorHost may terminate the Agreement without cause by giving 30 days’ written notice. In that case, the fee for the unused period is refunded to the Customer.
14 Domain Services
- 14.1 Domain registration, renewal and transfer operations are subject to the rules of the relevant registry authority (ICANN, TRABİS and others).
- 14.2 Renewing a domain on time is the Customer’s responsibility. SaviorHost is not liable for the loss of an expired domain or its registration by third parties.
15 Amendments
- 15.1 SaviorHost may update this Agreement. Changes are published on saviorhost.com and notified to the Customer’s registered email address at least 30 days before they take effect. A Customer who does not accept changes to its detriment may terminate the Agreement before the effective date and request a refund of the fee for the unused period.
16 Notices and Evidence
- 16.1 Notices between the parties are made through the email address registered in the Client Area and the support system. The Customer must keep its email address up to date; notices sent to the registered address are deemed received.
- 16.2 In disputes, SaviorHost’s electronic, system and server records constitute evidence under Article 193 of Turkish Code of Civil Procedure No. 6100. Consumers’ right to prove otherwise is reserved.
17 Governing Law and Dispute Resolution
- 17.1 This Agreement is governed by the laws of the Republic of Türkiye.
- 17.2 Customers who are consumers may apply to the Consumer Arbitration Committees at their place of residence or where the transaction was made within the monetary limits announced annually by the Ministry of Trade, and to Consumer Courts for disputes exceeding those limits.
- 17.3 For disputes with Customers who are merchants, the Courts and Enforcement Offices of Ankara have jurisdiction.
18 Entry into Force
- 18.1 This Agreement enters into force when the Customer gives electronic consent during ordering.
- 18.2 The invalidity of any provision of this Agreement does not affect the validity of the remaining provisions.
